It is important to retain an attorney as soon as possible
after an accident happens. Even if the accident is not your
fault, your interests need to be protected. Insurance companies
look out for their own interests, not yours. Their goal is
to settle a case for as little money as possible, which means
settling quickly before you have the time to retain an attorney
and assess your damages. Since most injuries tend to become
worse over time, settling a case quickly could be the worst
thing you could do. Remember, if you are hurt by the negligence
of someone else, you are entitled to more than just having
your medical bills paid; you are also entitled to damages
for your pain and suffering. To protect your rights you need
an experienced attorney to fight for you; no one wants to
face the big insurance companies alone.
BASIC INFORMATION:
Harold E. Campbell, P.C. offers a free initial consultation
to all persons hurt in an accident. If we accept your case,
our fees are paid on a contingent fee basis. This means we
only get paid if we obtain money damages for you. If we don't
obtain damages for you, our fees are zero. Our fees are paid
out of the settlement or court ordered judgment obtained so
there is no money up front. Although you are ultimately responsible
for all legal costs of your case (filing fees, witness fees,
etc.), we will advance these fees for you. Our goal is to
obtain money damages for you to compensate you for your property
damage, medical expenses and pain and suffering.
Before a personal injury case is settled all treatment should
be complete. This is the best way to ensure that the settlement
amount is large enough to compensate your losses. Most doctors
will agree to wait to be paid out of the settlement funds
if you have retained an attorney. The other doctors will need
to be paid either through your own insurance or out of your
pocket and recovered later.
Property settlement for damage to a vehicle may be obtained
before a personal injury settlement; they are two separate
issues. If a settlement cannot be reached, a lawsuit may be
filed against the party at fault. |
COMMON QUESTIONS:
What Is Personal Injury?
Personal injury is damage done to a person's body by the
fault of another. Some of the ways this occurs are auto accidents,
slip and fall cases, swimming pool accidents, and dog bites.
What Happens To My Car If It Is Damaged In An Accident?
If the accident is not your fault, you are entitled to have
your car repaired or, if the cost of the repair is more than
the value of your car, to be paid the fair market value of
your car. While your car is being repaired you are entitled
to a rental car from the insurance company.
Will I Have To Go To Court?
Maybe. Every effort is made to work out an agreed amount
for damages before a lawsuit is filed. However, insurance
companies are becoming increasingly more difficult to obtain
a fair settlement from. Harold E. Campbell, P.C. does not
abandon you here if a fair settlement is not offered. We will
file a lawsuit for you and represent you all the way through
trial.
What If The Person That Caused The Accident Has No Insurance?
Sometimes the party at fault has no insurance. You may still
be able to obtain damages from your own uninsured, underinsured,
or homeowner's insurance policy, as well as the party at fault
if he has substantial assets. Harold E. Campbell, P.C. will
assist you in determining all your sources of recovery.
What Do I Do First?
Call Harold E. Campbell. P.C. to set up an appointment as
